Nipplegate is Back

Remember that fine bit of public policy when the Federal Communications Commission ruled that 9/16th of a second’s exposure of Janet Jackson’s nipple was a terrible shock for the American public to be subjected to?

Sigh. What a silly country, silly waste of time, silly waste of money.

The Supreme Court directed the 3rd U.S. Circuit Court of Appeals in Philadelphia to consider reinstating the $550,000 fine that the Federal Communications Commission imposed on CBS over Jackson’s breast-baring performance at the 2004 Super Bowl.

I hope the appeals court reaffirms its original judgment.
